Whether you are a landlord, a tenant, a caretaker, or responsible for the maintenance and/or repair of non domestic premises, you carry the duty to manage Asbestos Containing Material (ACMs) in the premises you are responsible for.

Under Regulation 4 CAWR (2002) you have the legal duty to provide a register of all ACMs present in your premises.

The MDHS 100 states that an asbestos register must indicate the location of ACMs, assess their type of material, assess the type of asbestos present, assess the condition and their likelihood to be damaged and release asbestos fibres.

The likelihood of exposure to asbestos is also required for each material present in the register. This likelihood is monitored through a risk assessment complying with the MDHS 100.

All those information must be gathered and compiled together to elaborate an appropriate asbestos management plan which must be accessible to everyone who is liable to work or disturb any ACMs present in the premises.
